Removal of Osun CJ:- Governor Adeleke and Osun State House of Assembly's Assault on Judicial Independence in Osun: Urgent Call for Reinstatement - Osun IPAC Chairman

The recent actions taken by Governor Adeleke and the Osun State House of Assembly to suspend and replace the Chief Judge, Justice Oyebola Adepele-Ojo, despite a court order, are deeply troubling and raise serious concerns about the independence of the judiciary in Nigeria. 

The appointment and dismissal of judges should not be subject to the whims and fancies of politicians. It is essential for a healthy democracy that the judiciary remains separate from the other branches of government, allowing it to perform its constitutional duty of upholding the rule of law and protecting the rights of citizens. The actions of Governor Adeleke and the Osun State House of Assembly undermine this principle of separation of powers and pose a threat to the independence and integrity of the judiciary. 

The Constitution of Nigeria clearly establishes the framework for the appointment and removal of judges, ensuring that it is done in a fair and transparent manner, free from political interference. The actions taken by Governor Adeleke and the Osun State House of Assembly are a clear violation of these constitutional provisions and an assault on the judiciary. 

The suspension of Justice Adepele-Ojo and the appointment of Justice Afolabi in an acting capacity based solely on a resolution of the House of Assembly is unwarranted and lacks legal basis. The judiciary should not be subject to arbitrary decisions made by politicians, but should instead operate based on the principles of law and justice. 

The actions of Governor Adeleke and the Osun State House of Assembly appear to be aimed at intimidating the judiciary and undermining its independence. These actions set a dangerous precedent and send a message that politicians can interfere with the judiciary whenever it suits their interests. This erodes the public's trust in the judiciary and undermines the credibility of the democratic system. 

In light of these concerns, we strongly urge for the immediate reinstatement of Chief Judge Justice Oyebola Adepele-Ojo. This is necessary to protect the independence of the judiciary and uphold the principles of the separation of powers as enshrined in the Constitution of Nigeria. It is essential that the actions of Governor Adeleke and the Osun State House of Assembly are rectified to ensure the integrity and independence of the judiciary are upheld.
